1. Agreement to Terms

By accessing or using HardChoice ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

HardChoice is operated by ChamsDel Online LLC (the "Company," "we," "us," or "our"). These Terms constitute a legally binding agreement between you and the Company.

2. Description of Service

HardChoice is a decision-making tool designed to help couples make difficult choices together. The Service allows users to:

• Create and manage decisions with a partner
• Define decision options and criteria
• Prioritize individually and compare perspectives
• Make decisions together with full awareness of tradeoffs
• Track decision outcomes through check-ins

The Service is provided "as is" and may be modified, suspended, or discontinued at any time without notice.

3. Eligibility

You must be at least 18 years old to use HardChoice. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

4. Account and Session Management

4.1 Session-Based Access

HardChoice allows you to use the Service without creating a traditional account. We use session-based identification that is stored locally on your device. You are responsible for maintaining the security of your device and session.

4.2 Join Codes

Decisions can be shared using 6-digit join codes. You are responsible for keeping join codes confidential and sharing them only with intended participants. We are not responsible for unauthorized access resulting from shared or compromised join codes.

4.3 Account Responsibility

You are responsible for all activities that occur under your session or using your join codes. You agree to notify us immediately of any unauthorized use or security breach.

5. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service or other users' data
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any copyright or proprietary notices from the Service

6. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Important: HardChoice is designed with privacy in mind. However, once you choose to reveal your decision data to your partner, that information becomes visible to them. This is an intentional feature of the Service.

7. Payment Terms

7.1 Decision Credits

HardChoice uses a credit-based pricing model. You purchase decision credits that are consumed when you reveal a decision. Credits are non-refundable except as required by law.

7.2 Payment Processing

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full payment card information.

7.3 Refunds

All sales are final. Refunds may be provided at our sole discretion or as required by applicable law. Unused credits do not expire, but we reserve the right to modify this policy with reasonable notice.

7.4 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect credits you have already purchased.

8. Intellectual Property

8.1 Service Ownership

The Service, including all content, features, functionality, and technology, is owned by ChamsDel Online LLC and is protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of the decision data and content you create using the Service. By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and display your content solely for the purpose of providing the Service.

8.3 Feedback

Any feedback, comments, or suggestions you provide about the Service may be used by us without restriction or compensation to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The Service is free of viruses or other harmful components

Important: HardChoice is a decision-making tool, not a substitute for professional advice. The Service does not provide legal, financial, medical, or therapeutic advice. You should consult with appropriate professionals for decisions requiring such expertise.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHAMSDEL ONLINE LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any decisions made using the Service
• Unauthorized access to or alteration of your data
• Any other matter relating to the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless ChamsDel Online LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the Service

12. Termination

12.1 By You

You may stop using the Service at any time. You can delete your decision data through the Service interface.

12.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including if you breach these Terms.

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive.

13. Beta and Pre-Launch Status

HardChoice is currently in beta/pre-launch. During this period:

• The Service may contain bugs, errors, or incomplete features
• We may make significant changes to the Service without notice
• Data may be lost or reset during updates
• We may discontinue the Service or certain features

By using the Service during beta, you acknowledge these risks and agree that we are not liable for any issues arising from the beta nature of the Service.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution Process

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChamsDel Online LLC regarding the Service and supersede all prior agreements and understandings.
